Terms of Service

1. Service Description

Basable ("we", "our", "the Service") is an AI-powered application deployment platform operated from the Netherlands. The Service enables users to describe, generate, and deploy web applications using artificial intelligence.

2. Alpha service — provided as is

The Service is in alpha, for an indefinite period with no committed end date, and is provided "as is" and "as available" without warranty of any kind. During alpha we accept no liability for anything that happens to the websites and applications you deploy, including downtime, suspension, deletion, data loss, corruption, failed deployments, or the loss of anything the AI assistant generated.

Keep your own backups of anything you value. Your code also lives in a git repository that belongs to you, which you can clone at any time — see section 6.

Nothing in this section limits liability that cannot be excluded under Dutch law.

3. Acceptance of Terms

By creating an account or using the Service, you agree to be bound by these Terms of Service, our Privacy Policy, and our Acceptable Use Policy. If you do not agree, you may not use the Service.

4. Account and Eligibility

You must authenticate with a valid email address (via a one-time login code) or a passkey registered to your account to use the Service.

You are responsible for maintaining the security of your account and for all activity that occurs under it. You must be at least 16 years of age to use the Service.

5. User Obligations

• Comply with all applicable laws and regulations.
• Comply with our Acceptable Use Policy.
• Provide accurate information when creating your account.
• Not share your account credentials or transfer your account to others.
• Promptly notify us of any unauthorized use of your account.

6. Intellectual Property

You retain all ownership rights to code, content, and applications you create using the Service. We do not claim any intellectual property rights over your deployments or source code. The Service itself, including its design, features, and underlying technology, remains our property.

7. AI-Generated Content

The Service uses artificial intelligence to generate code and application configurations. AI-generated output is provided "as is." You are responsible for reviewing, testing, and ensuring the suitability of any AI-generated content before deploying it to production.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control. We are not liable for any downtime or data loss.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Basable and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. Our total aggregate liability shall not exceed the amount you have paid us in the twelve months preceding the claim. While the Service is in alpha, section 2 applies in addition to this section.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or our Acceptable Use Policy, or if required by law. Upon termination, your right to use the Service ceases immediately. We will make reasonable efforts to allow you to export your data before deletion.

11. Modifications

We may update these Terms from time to time. We will notify you of material changes by posting a notice on the Service or by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the Netherlands. Any disputes arising from these Terms or the Service shall be submitted to the competent courts in the Netherlands.
